Terms of Service

1. The Service

Resale Lister lets you upload photos of an item and generates a marketplace listing (title, description, category, condition notes, suggested tags, and an estimated price range) using an AI model, tailored to a marketplace you select (eBay, Poshmark, Depop, Mercari, or Facebook Marketplace). You are responsible for reviewing, editing, and posting any generated content yourself — we do not post listings on your behalf and are not affiliated with, endorsed by, or acting on behalf of any of those marketplaces.

2. Accounts

You must provide accurate information to create an account and are responsible for all activity under your account and for keeping your login credentials secure. You must be at least 18 years old to use the Service.

3. Subscriptions, Trial, and Billing

The Service is offered on a paid subscription basis (currently a Starter and a Pro plan, as described on our Pricing page). New accounts receive three (3) free listing generations at no charge. After those free listings are used, you must subscribe to a paid plan to continue generating listings. Subscriptions are billed in advance on a recurring monthly basis through our payment processor, Stripe, and do not automatically start a paid subscription without your affirmative action to check out and provide payment details.

You can cancel your subscription at any time from your account’s billing settings; cancellation takes effect at the end of your current billing period, and we do not provide prorated refunds for partial billing periods except where required by law or at our discretion.

Plan limits (such as the number of listings included per month) are described on our Pricing page and may change with notice posted on that page.

4. Your Content

You retain ownership of the photos and information you upload (“Your Content”). By uploading Your Content, you grant us a limited license to process it — including sending it to our AI provider — solely to generate listing content for you. You represent that you have the right to upload Your Content and that it does not infringe any third party’s rights.

5. AI-Generated Content

Listing content, condition assessments, and price ranges are generated automatically by an AI model and may contain errors, omissions, or inaccuracies. You are solely responsible for reviewing and verifying all generated content — including accuracy of item descriptions, condition, and pricing — before posting it anywhere. We do not guarantee that generated content is accurate, complete, or suitable for any particular marketplace’s rules or your intended use.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose, or to list unlawful, stolen, or counterfeit goods;
• Upload content that infringes another party’s intellectual property or other rights;
• Attempt to abuse, circumvent, or manipulate usage limits, billing, or the free listings offer (including creating multiple accounts to obtain additional free listings);
• Interfere with or disrupt the Service or attempt to access it through unauthorized means.

We may suspend or terminate accounts that violate these Terms.

7. Third-Party Marketplaces

Resale Lister is an independent tool and is not affiliated with, sponsored by, or endorsed by eBay, Poshmark, Depop, Mercari, Facebook Marketplace, or any other marketplace referenced in the Service. Each marketplace has its own terms and listing policies, which you are responsible for complying with.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL BE ACCURATE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICE OR ANY GENERATED CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

10. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or if required by law.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms will be governed by the laws of the State of Illinois, USA, without regard to conflict-of-law principles.
